Businesses of all sizes have been experiencing data breaches, ransomware attacks, and other cyber events at an alarming and increasing rate over the past few years. As the costs associated with these events can be catastrophic, more and more businesses are choosing to protect against these risks, in part, through cyber insurance. Because this coverage is relatively new and not yet addressed by a uniform policy, it can vary dramatically from carrier to carrier based on different coverages, definitions, and exclusions. Additionally, many of the operative terms used in cyber policies have not yet been examined or explained by courts. As a result, there is significant uncertainty about what is actually covered by these relatively new and untested policies. Navigating the Labyrinth of Cyber Insurance will address (1) the most common types of covered cyber risks; (2) key exclusions to be aware of; (3) how to negotiate enhanced coverage; and (4) best practices for tendering claims and responding to claim denials.
